Edgewalk – liability agreement

TV TOWER REQUIREMENTS, TERMS AND CONDITIONS FOR THE ATTRACTION “EDGEWALK”

1. These terms and conditions for use of the “Edgewalk” attraction (hereinafter: edgewalk sets forth the rights, responsibilities and liability of visitors to SA Tallinn Teletorn (Tallinn TV Tower foundation, registry code: 90012142; hereinafter: TV Tower) and edgewalk participant (hereinafter: participant) in connection with the edgewalk attraction sited and held at the TV Tower.

2. The terms and conditions shall be applicable to all participants who use edgewalk.

3. Participants must:

a) weigh more than 34 kg and less than 140 kg;

b) be 13 years or older. The persons 13-17 years of age may take part in edgewalk only with the consent of a legal guardian accompanying them; said person shall monitor and ensure that persons 13-17 years of age accompanying him or her comply with all terms and conditions in due manner;

c) be of sound physical health, have adequate hand-eye-mouth coordination and be capable of walking independently (without assistive or medical devices).

4. Participation in edgewalk is prohibited if the participant:

a) is pregnant;

b) has a bone fracture;

c) has been operated on surgically in the last 6 months;

d) has in the last six months experienced acute episodes of disease as a consequence of which the participant has been prohibited to hold a driving licence;

e) experiences chest pain or shortness of breath;

f) is under the influence of a medicinal product or has used alcohol or narcotic substances.

5. In addition to the above, the following states may impact the ability of the person to walk safely:

a) all cardiovascular diseases (including high blood pressure);

b) all respiratory diseases;

c) total or partial absence of limbs (prosthetic devices are not allowed);

d) dizziness, vertigo or balance problems;

e) vision problems (other than wearers of glasses or contact lenses).

6. Before the beginning of edgewalk the participant shall undergo a visual check to ascertain that they are not under the influence of alcohol or narcotic substances or carrying explosives.

7. No belongings other than the clothing being worn and glasses may be taken on edgewalk.

8. TV Tower has the right to ask the ticket buyer and legal representative for an ID to ascertain age if the ticket buyer is underage.

9. Edgewalk tickets are valid on the date/time for which they were booked. The fee paid for the tickets shall not be refunded or compensated to participant unless edgewalk cannot be traversed due to the fault of the TV Tower. TV Tower must be notified of changes in the booked date/time at least 72 hours before the start of the booked session.

10. TV Tower reserves the right to cancel edgewalk sessions without advance notice due to inclement weather. Cancellation for the reasons specified in the previous sentence shall be substituted by a rain check, tickets shall not be refunded. TV Tower shall do its utmost to organize a rain-check session as soon as possible at a time suitable for the participant who bought the ticket.

11. Edgewalk ticket also allows, in addition to participation in the edgewalk session, a single admission to TV Tower along with all services ordinarily included in the price of an admission ticket to TV Tower.

12. TV Tower has the right to deny participation to persons whose condition and/or abilities do not conform, upon visual check by TV Tower representatives and in their judgment, to these terms and conditions or do not otherwise allow edgewalk to be safely traversed. In such a case, TV Tower has no obligation to compensate the cost of the ticket to the person who bought it, nor to enable participation in a rescheduled session using the same ticket.

13. The participant may not enter the edgewalk course before receiving instructions and safety equipment from a TV Tower employee for safely traversing edgewalk. Before using edgewalk, the participant must make certain that the course conforms to his or her physical abilities, health condition and abilities.

14. Upon use of edgewalk, the participant is obliged to comply with all terms and conditions, additional instructions and commands from TV Tower employees as well as with the signs and markings along the course.

15. The participant is aware that use of edgewalk may cause damage to his or her clothing and belongings and that it is hazardous to the life and health of the participant if the participant does not comply with all instructions, safety and security requirements provided by TV Tower employees and the requirements set forth in the terms and conditions. Participation in edgewalk takes place at the participant’s own risk and TV Tower waives all liability for any damage incurred by participants (including to health and property) if the damage was caused by non-adherence to these terms and conditions by the participant and/or the participant’s negligence in traversing edgewalk.

16. TV Tower employees shall have the right to immediately call participants back from edgewalk if the participant violates terms and conditions, does not comply with commands issued by TV Tower employees or if traversing edgewalk is in the judgement of the TV Tower employee no longer safe. Should the participant’s well-being or weather conditions deteriorate to a degree rendering edgewalk no longer safe, the participant must immediately leave the course.

17. Use of edgewalk without safety equipment is strictly prohibited and is hazardous to life and health!

18. Safety equipment may not be transferred to third parties and after the course is traversed once, the safety equipment is to be immediately returned to TV Tower. Participants are obliged to use the edgewalk safety equipment with care and not to damage it in any way. Participants shall compensate the TV Tower for all losses caused by damage to security equipment through the fault of the participant.

19. Upon buying a ticket, the participant consents to fulfil all of the TV Tower’s general internal rules and these terms and conditions.

20. The cost of an edgewalk ticket paid to TV Tower shall be refunded to participant only if traversing edgewalk is no longer possible due to the fault of TV Tower.

21. The participant accepts liability for all risks and dangers and releases TV Tower and its managers, partners and employees from any liability for bodily injuries, loss or destruction or damage to property or other losses caused by factors other than gross negligence or deliberate action by the TV Tower.

STATEMENT BY ADULT LEGAL REPRESENTATIVE OF A JUVENILE: I CERTIFY THAT I AM VISITING EDGEWALK AS THE CHAPERONE OF JUVENILES (UNDER 18 YEARS OF AGE) OF WHOM I AM THE LEGAL REPRESENTATIVE (PARENT OR GUARDIAN) AND I AFFIRM BY SIGNATURE THAT I CONSENT TO THE JUVENILES LISTED BELOW TAKING PART IN EDGEWALK AND I UNDERTAKE TO BE RESPONSIBLE FOR THEM PURSUANT TO THE TERMS AND CONDITIONS.
